Terms & Conditions

 

1. The tenant shall have the right to occupy and use for a holiday the Apartment specified in Paragraph 3 of the Particulars forming part of the Building specified in Paragraph 4 of the Particulars together with the use of the entrance ways, entrance halls, staircases and passages of the Building in common with other tenants and occupiers thereof and the furniture and effects therein for the period specified in Paragraph 5 of the Particulars at the rent specified in Paragraph 6 of the Particulars for every week of the period to be paid in advance on the signing thereof.

 

2. The Tenant will:-

 

2.1) Pay the rent on the days and in manner aforesaid, together with a separate Breakages Deposit cheque of  £75.00. The Breakages Deposit cheque should be returned with the Holiday Letting Agreement form and dated to be valid for the time of your stay. This is not banked and is destroyed after your departure, assuming the property is left in good order. This deposit is intended for and may be used to offset the cost of remedying any damages, breakages or losses sustained, or any unbudgeted cost incurred by The Osborne Club for restoring the property to a truly clean and tidy state. If guests paying by credit card do not send a Breakages Deposit cheque, it will be assumed The Osborne Club may charge the card for any damages up to the amount of the required Breakages Deposit cheque.

 

2.2) Not make any alterations in or addition to the Apartment.

 

2.3) Not do or suffer to be done in the Apartment anything, which may be or become a nuisance or annoyance to the Owner or Agent or to the tenants or occupiers of the rest of the Building or the adjoining premises or may vitiate any insurance of the Building against fire or otherwise or increase the premium thereon.

 

2.4) Take all reasonable and proper care of the Building, to include the halls, stairways and lifts, the Apartment and its furniture, pictures, fittings and effects in the Apartment and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the rental period as at the beginning. The Tenant is legally bound to reimburse The Osborne Club for replacement, repair or extra cleaning costs on demand.

 

2.5) Not remove any of the said furniture and effects from the Apartment.

 

2.6) Not assign underlet charge or part with or share the possession or occupation of the Apartment or any part thereof or of the said furniture or effects of any of them.

 

2.7) Not use the Apartment or any part thereof for any other purpose than that of a private holiday residence limited to the number of occupants specified in Paragraph 7 of the Particulars. The Osborne Club reserves the right to refuse entry to the entire party if this condition is not observed. A cot may only be occupied by a child aged 24 months or less.

 

2.8) Not keep or bring into the apartment, building or grounds any dog or cat or other live animal or bird.

 

2.9) Yield up the apartment at the end of the tenancy with all the said furniture.

 

2.10) Pay all charges [if any] for use of the telephone etc in the Apartment during the tenancy.

 

2.11) Permit the Owner or the Owner's Agent at reasonable hours in the daytime to enter upon and view the apartment with prospective tenants or occupiers, and to carry out necessary repairs.

 

2.12) To vacate the apartment by 10.00am on the day of expiry of letting. Occupation of the Apartment is from 4.00pm on the first day of the Period of Letting.

 

3. PAYMENT. A non-refundable deposit of one-third of the rental fee is payable if the booking is made more than 8 weeks before the start of the rental. The balance shall be payable 8 weeks before the commencement of the rental. Non-payment of the balance of the rent on or before the due date shall be construed as a cancellation of the contract by the tenant. For bookings made less than 8 weeks before the commencement of the rental the total fee is payable. Payment can be made by cheque [made payable to The Osborne Club] or debit card. There is a surcharge of 1.7% if paying by credit card (regrattably we cannot except American Express or Diners Club).

 

4. CANCELLATION. Any cancellation made by the Tenant for whatever reason shall be in writing and addressed to The Osborne Club. On receipt of notice of cancellation, The Osborne Club will seek to re-let the apartment for the period of booking. If The Osborne Club succeeds in re-letting the property for the whole period it shall refund all the monies paid less an administrative charge of £20 + VAT per booking. If The Osborne Club only succeeds in re-letting the property for part of the period booked it shall refund an amount equal to the money paid less [1] the rental for the period which is not re-let and [2] an administrative charge of £20 [plus VAT]. If The Osborne Club is unable to re-let the property at all then all monies paid by the Tenant shall be forfeit to The Osborne Club. The Osborne Club strongly recommends Tenants to take out Cancellation Insurance.

 

5. ALTERNATIVE ACCOMMODATION. If for any reason beyond The Osborne Club's control, the confirmed and booked property becomes unavailable on the date booked [owing to fire or storm damage for example], The Osborne Club will endeavour to offer suitable alternative accommodation of a similar type, standard and rental. If the offered alternative is not acceptable, or the Club is unable to offer a suitable alternative, the Club will refund all monies paid. The Tenant shall have no further claim against the Owners or The Osborne Club.

 

6. LIABILITY. The Osborne Club [for itself and its employees] and the Owner shall not be liable to the Tenant or third parties for any accident, damage, loss, injury expense or inconvenience, which may be suffered, incurred, arise out of or in any way connected with the rental.
